Birth, death, marriage, and divorce records are managed by the Vital Records Section of New York Department of Health for most of the state from 1881 to present. Birth records for New York City, however, are managed by the New York City Department of Health and Mental Hygiene. New York City marriage records are managed by the New York City Marriage Bureau.
Certified copies of birth records are only available to the registrant or the parents. Certified copies of birth records may be available to spouses and children, or other individuals with a court order. Non certified copies of birth records are available to direct line descendents, such as children and grandchildren. Birth records are also available to the general public if the record was on file for at least 75 years, and the registrant is deceased. Certified death records are available to the spouse, parent, or child of the deceased as well as those with a documented legal right, documented medical need, or a court order. Non-certified death records are available to the public if the record has been on file at least 50 years.
Certified marriage records are available to the bride, groom, those with a documented proper or judicial purpose, and those with a court order. Non certified copies are available to the public if the bride and groom are deceased and the record has been on file for at least 50 years. Divorce certificates are available from the Department of Health from January 1, 1963 to present. Divorce certificates are available to the husband, wife, or those with a court order. Divorce decrees, which are the actual court document, can be obtained from the County Clerk in the county where the divorce was finalized.
Birth, death and marriage records from the Cities of Albany, Buffalo and Yonkers prior to January 1, 1914 are not managed by the Department of Health. Birth and death records from these cities are available through the Local Registrar. Marriage records can be found with City Clerk in the city where the marriage license was filed.
